By accessing or using the Book That Boat website or booking any services through our platform or WhatsApp channel, you agree to comply with and be bound by the following Terms & Conditions.
Definitions
In these Terms & Conditions, unless the context otherwise requires:
- "We", "Us", "Our" refer to Book That Boat.
- "You", "User" refer to individuals or entities accessing or using our platform or services.
- "Boat Owner" refers to the owners and/or operators offering their boats for rent on our platform.
Scope of Service
Book That Boat acts as an intermediary between Users and Boat Owners, facilitating bookings for boat rentals. We do not own, operate, or manage the boats listed on our platform and are not the direct provider of any charter services. All boating services are provided by independent Boat Owners and their crew.
Booking and Payment
3.1 Booking Process
- All bookings must be made through our website or via our official WhatsApp channel.
- You are responsible for reviewing all booking details (date, time, duration, number of guests, and inclusions) before making payment.
3.2 Payment Methods
- We accept payments via multiple channels, including but not limited to bank transfer, card payments, and payment links.
- Payments made via a payment link may be subject to a processing fee, which will be communicated to you at the time of booking.
3.3 Booking Confirmation
- A booking is only confirmed once payment has been received and a confirmation email or written confirmation has been issued by Book That Boat.
- Until confirmation is issued, availability and pricing are subject to change.
Cancellations and Refunds
4.1 No-Quibble Refund (More Than 72 Hours)
You may cancel your booking for a full refund, provided that the scheduled departure time is more than 72 hours away at the time of cancellation.
4.2 Cancellations Less Than 72 Hours Before Departure
- Cancellations made between 72 and 24 hours prior to departure are eligible for a 50% refund.
- Cancellations made within 24 hours of the scheduled departure are considered non-refundable, and no reimbursement will be issued.
4.3 Exceptional Circumstances
If your trip is affected by severe weather, operational issues, safety concerns, or other extraordinary events beyond reasonable control, we may offer either:
- A full refund, or
- A free rescheduling to another available date and time, as per our policy.
4.4 No-Show Policy
Failure to appear for your scheduled booking without prior cancellation will be considered a "no-show". In such cases:
- The booking is non-refundable.
- The full amount paid will be forfeited.
Late Arrival Policy
- Guests are required to arrive at the designated meeting point at least 15 minutes before their scheduled booking time.
- If guests fail to arrive on time, the booking duration will not be extended, and the boat will return as scheduled.
- Late arrivals may result in a reduced rental period or forfeiture of the booking without entitlement to refunds or rescheduling.
- To maintain operational schedules and fairness to other customers, exceptions cannot generally be made.
User Responsibilities
6.1 Accurate Information
You must provide accurate, complete, and truthful information during the booking process. Book That Boat is not responsible for issues arising from incorrect details supplied by you.
6.2 Compliance
You are responsible for adhering to all applicable laws, regulations, marina rules, and the onboard policies of the boat and crew during the rental period.
6.3 Damages and Violations
Any damages, fines, penalties, or violations incurred during the rental period are the sole responsibility of you and your guests. You may be charged for:
- Damage to the vessel or its equipment.
- Cleaning fees for excessive mess or misuse.
- Fines associated with illegal or unsafe behaviour.
6.4 Identification Requirement
All guests may be required to present valid identification prior to departure. Failure to provide valid ID may result in denial of boarding, and no refunds will be issued in such cases.
Liability Disclaimer
Book That Boat operates solely as an online marketplace connecting Users with independent Boat Owners. We do not own, manage, or operate any boats listed on our platform and are not responsible for the acts or omissions of Boat Owners, crew, or third parties.
To the maximum extent permitted by law, we assume no responsibility or liability for:
- Personal Injury or Death: Any bodily harm, injury, or loss of life, including incidents resulting from swimming, diving, or engaging in water activities, whether or not safety equipment (such as life jackets) is used.
- Property Damage: Any damage to the rented vessel, your personal belongings, or third-party property.
- Operational Disruptions: Disruptions caused by adverse weather, mechanical failures, technical issues, or other unforeseen circumstances.
- User Conduct: Consequences arising from improper use of the vessel, disregard of safety instructions provided by the Boat Owner or crew, or violations of applicable laws and regulations.
- Legal Compliance: Any fines, penalties, or legal consequences imposed due to violations of local laws or regulations by you or your guests during the rental period.
Intellectual Property
All content on the Book That Boat platform, including but not limited to text, graphics, logos, designs, and images, is the intellectual property of Book That Boat or its licensors. Unauthorized use, reproduction, or distribution of any content is strictly prohibited without our express written consent.
Modifications to Terms
We reserve the right to modify, update, or amend these Terms & Conditions at any time. Changes will take effect immediately upon posting on our website. You are encouraged to review this page periodically to stay informed of any updates. Continued use of our platform after changes are posted will constitute your acceptance of the revised Terms.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
Privacy Policy
We are committed to protecting your privacy. Any personal data collected during the booking process or use of our website will be handled in accordance with our Privacy Policy. Please review our Privacy Policy for detailed information on how your data is used, stored, and protected.
Indemnification
By using our platform, you agree to indemnify, defend, and hold harmless Book That Boat, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the platform or services.
- Your rental of any boat listed on our platform.
- Your breach of these Terms & Conditions or any applicable law.
- Any claim brought by a third party arising from your actions or those of your guests.
Assumption of Risk
By participating in boat rentals or related activities facilitated through our platform, you acknowledge and understand that boating, water sports, and marine activities carry inherent risks, including the risk of serious injury, disability, or death. You voluntarily assume all such risks associated with your participation and that of your guests.
Force Majeure
Book That Boat shall not be held liable for any failure to perform or delays in performance caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, strikes, labour disputes, war, civil unrest, government restrictions, pandemics, or technical failures. In such cases, refunds or rescheduling will be handled in accordance with our policies and the policies of the relevant Boat Owner.
